Lake Oswego & the entire metro area is moving right along.

Here are the latest/March numbers for the entire Portland area:

According to the RMLS Market Action Report for the Portland Metro Area, march, 2016:

  • There were 3,409 New Listings in March which was up 17.7% from February (2,896), and 5.2% down from March of 2015 (3,596).
  • At 2,565, March Closed Sales were up a whopping 41.5% from February’s 1,813, and up 4.4% from March of 2015’s 2,457.
  • March Pending Sales (Accepted Offers), at 3,076 were up  10.4% from February’s 2,786, but were   9.1% under March of 2015’s 3,384 total.
  • The Average Sale Price in March of $385,100 was up around $20,000 over February’s $364,900, and also up around $15,000 from March of 2015’s $368,800.

The combined areas of Lake Oswego and West Linn  (RMLS lumps them together) for the month of March 2016 reported:

    •  284 Active Listings  (Feb was 260)
    •  189New Listings   (Feb was 185 )
    •  150 Pending Sales    (Feb was 147)
    •  114 Closed Sales   (Feb was 99)
    • Average Sale Price for March: $639,500 (Feb/$577,500. )
      • NOTE: Higher-Priced vs Lower-Priced Homes Sales can skew the “Average” in any given month.  Lake Oswego has quite a variety, so this tends to be a less meaningful stat, generally speaking, in this niche.
    • Average Time on the Market: 92 Days (Feb was 92 also!)

The Importance of Seller Disclosure

lake-headerI am directing this post to people who are selling a home, but the knowledge is also important to folks who are buying a home. Oregon has very specific disclosure laws that all people selling real estate must abide by. There are a few exceptions, but they are rare.

To put it simply, when selling a house (this includes condos) you must tell what you know if it is material to the property. Material is physical and real. You must tell what you know. At the time that you list your property for sale you will be asked to complete a 5-page disclosure statement. This statement is a series of questions that will prompt your memory about everything from any deed restrictions to physical defects such as a leaking roof or faulty furnace. I advise my clients to leave no question unanswered. Even if it doesn’t apply to your property choose the option “n/a” or write “n/a” in the margin.

The point at which a buyer receives the disclosure statement is when their offer has been accepted. They are excited and eager to learn more about the house. Once they receive the statement they have 5 business days to revoke their offer. I also think of this as a bit of a cooling offer period. If they are going to get cold feet, let it happen early in the process and before the buyer or the seller have invested more time in the sale. So if the fact that the roof once leaked or the attic was once treated for mold is going to freak them out, find out early, let the deal come apart and everyone can move on. Doing it early is so much better than after the seller looses two weeks of market exposure while the buyer does a home inspection and then finds evidence of a past roof leak or of past mold.

So what should you disclose? EVERYTHING! Even if it seems minor. Even if it has been fixed and never happened again. This is your chance to tell what you know. Our disclosure statement has a 6th page for giving explanations. You can add a 7th, 8th, and 9th page. It simply is not possible to tell too much. When the buyer does the inspection, they are going to find evidence of past defects such as water stains or newer sections of plumbing. If nothing was said in the disclosure statement it makes the buyer feel suspicious. “What else didn’t they tell me?’. Where as if you have done a thorough job of disclosing, they buyer will find the evidence and feel like “OH, sure, they told me about that.”

The bottom line is that you have a legal obligation when you sell real property to tell what you know.

There are 4 exceptions:
If the house is brand new construction (in that case the disclosure requirement is replaced by the permit requirements of the local jurisdiction)
If the house is a bank owned property such as a foreclosure
If the sale is being handled by a legal entity such as a trustee, personal representative, conservator, or guardian
If the seller is a government agency

That’s it. Those are the only exceptions. This means that even if you have never lived in the house but have had it as an investment, you must still disclose what you know about the material condition of the property.

What if something is wrong with the property that you don’t know about? You do not have to disclose what you don’t know. You only have to disclose what you do know. So if the buyer does an inspection and finds defects you don’t know about you may end up negotiating to fix those defects but you aren’t at fault for not knowing about them before hand.

Now I’ve got to give my full disclosure. I am not an attorney. Always seek legal council if you feel you don’t understand this or if you have questions. What I am telling you is my advice based upon my experience.

I’m tellin ya… This market is hot! And there are some great homes out there.

Here are the latest/February numbers for the entire Portland area:

According to the RMLS Market Action Report for the Portland Metro Area, February, 2016:

  • There were 2,896 New Listings in February which was up 15% from January (2,519), and rose over February of 2015 (2,884) slightly, by 0.4%.
  • At 1,813, February Closed Sales fell 2.5% from January’s 1,859, and/but were up 10% from February of 2015’s 1,648.
  • February Pending Sales (Accepted Offers), at 2,786 were up 24.2% from January’s 2,243, and were 9.9% ahead of February of 2015’s 2,534 total.   ***This was the strongest February for Accepted Offers since 2007!
  • The Average Sale Price in February of $364,900 was up significantly from January’s $355,500, and also up almost $37,000 from February of 2015’s $328,000. (!!!)

News & Notes ~ Jan 2016 Numbers

First numbers for 2016!!! Yeah!!!

Here are the January numbers for the entire Portland area (including Lake Oswego).

According to the RMLS Market Action Report for the Portland Metro Area, January, 2016:

  • There were 2,519 New Listings in January which was up 63.8% from December (1,538), and 8.8% under January of 2015 (2,762).
  • At 1,859, January Closed Sales fell 31.4% from December’s 2,710, and/but were up  25.9% from January of 2015’s 1,477.               ***It was still the strongest January since 1992.
  • January Pending Sales (accepted offers), at 2,243 were up 15.9% from December’s 1,936, and were 2.8% under January of 2015’s 2,294 total.
  •  The Average Sale Price in January of $355,500 was down some from December’s end-of-year frenzy/$367,600, and also up approx $26,000 from January of 2015’s $329,400.

    •  243 Active Listings  (Dec was 255)
    •  150 New Listings   (Dec was 86 )

Market Snap Shot

l-lake-oswego-mansionIn a recent conversation with another Realtor here in Lake Oswego the comment was made “aren’t there any houses in Lake Oswego under a million dollars!”. It got me thinking about the fact that it’s been awhile since I did my affordability comparison with Sellwood in SE Portland. It also got me wondering about all the houses in Lake Oswego that are priced at a million dollars or greater. How many are there and are they selling?

I ran these numbers on February 1st and in 5 days time they will of changed, but it will give all of us a snap shot of current inventory and current activity.

There are currently 124 detached houses for sale. Of those, 56 are priced at a million dollars or greater. That means that million dollar properties make up 45% of the current inventory. I wanted to know how many million dollar homes had sold in the last six months. I decided if I was going to do it with the expensive houses I would also do it with the less expensive houses. Below you will find the results of my research:

So the answer to my question is that while there are a lot of million dollar houses, they are selling quite well. The far right column shows you that based upon how many have sold in the last 6 months, how many months it will take to sell what is currently on the market. The less expensive homes are selling in just weeks.

The real shocker in this, to me, is what has happened to the condos. I have never in 28 years of selling real estate seen the condo inventory so low. In my experience there always seems to be a bit of a glut of condos available. Last summer there were many and some complexes had so much inventory that they just languished on the market. So what happened? Many complexes that were involved in litigation and special assessments have put that behind them and are now more stable and more financially healthy. The foreclosures and shortsales are pretty much gone (there may be a few hold outs yet to appear), but mostly I think it’s because first time home buyers are back in the game. The millenials have had a hard time getting established in good jobs, but it is happening and they are buying homes. If you own a condo in Lake Oswego, it is likely going up in value.

Lake Oswego vs Sellwood
I started doing this comparison between LO and Sellwood (a neighborhood in SE Portland) because I have long felt that thinking of Lake Oswego as a strictly rich community is unfair. I think there are a fairly broad range of households and that you can find affordable housing in Lake Oswego. I used Sellwood for the comparison because it is where I moved from when I came to Lake Oswego 18 years ago. I used to do this comparison about once a year, but I don’t think I’ve done it for quite a long time. So hear it is. My definition is based upon a detached home that is priced at $400,000 or less. In Lake Oswego there are currently 6. In Sellwood there is currently 1. So it continues to hold true that there are more “affordable” houses in Lake Oswego than there are in Sellwood. This has been the case every time I have done this exercise. But the take away is “only 6”?! and “only 1”?! Our property values have gone up so much that I’m not sure I can use the $400,000 price cap any more, in either area.

Most expensive and least expensive
The last part of this review is that I want to give you an idea of the least and most expensive detached house value in Lake Oswego. The least expensive house is offered at $320,000. It was built in 1964 and has 3 bedrooms and 1 bath, and 924 square feet. It’s on a .24 acre lot, needs a lot of updating, and is on a septic system. The most expensive house is offered at $15,000,000. It was built in 2006. It has 5 bedrooms, 6 full baths and 3 half baths. It has an elevator, a media room, a game room, a workout room, and more. It has 13,462 square feet. It sits on .66 of an acre that happens to be lake front along the North shore. It has also been on and off of the market for the past 4 years.

News & Notes ~ December & 2015 Numbers

Well, the latest numbers for the entire Portland area for December and 2015 are in!  This is particularly interesting because the numbers are through December 31st…therefore there are figures for December (best look at what’s happening “right now”) AND for the entire year.

I usually give our Property Blotter Readers a glimpse at the whole Portland market and how Lake Oswego fits into it below. Here you go!

According to the RMLS Market Action Report for the Portland Metro Area:

  • There were 1,548 New Listings in December which was 2down / -0.1% from December of 2014, and also down 28.4% from November of 2015.
  • At 2,710, December Closed Sales were up a whopping 25.9% from November and up  21% over December of 2014.
  • December Pending Sales (accepted offers), at 1,936, fell 22.7% from November, and/but were up 16.1% over December 2014.
  •  The Average Sale Price in December of $367,600 was down $12,000 from November’s Average of $355,600, and up $36,000 (!!) from December 2014’s Average of $331,600.
  • The Year-End (Year-To-Date/YTD) Average Sale Price for the Overall Portland Area was $354,500. That compares to 2014’s YTD Average Sale Price which was $333,000.
  • The big story is about Inventory which was at 1.2 months as of December 31st…The lowest since 1999.

Market Activity ~ Jan 18-24, 2016

It is that time of year; the time where people who’ve taken their homes off the market during holiday season etc decide to put them back on or at least change their ML#’s to “refresh” the Listings for the new year. While this is a common practice, and is a useful strategy for Sellers to consider, it is not as helpful to our Property Blotter readers who are looking for new properties entering the market. So… we do the sorting work for you and remove those that have been refreshed in this manner. For this cycle, out of 13 that appeared to be New, we show 4 actually New in Lake Oswego.  (Yes, Inventory is still quite low. Overall Portland Area Inventory as of Dec 31st was 1.2 months…)
